Introduction

Welcome to EPIKTON, a service owned by Ramazan Yüksel. By accessing or using EPIKTON, including our website and music content (collectively referred to as “EPIKTON”, the “Service”, or the “System”), you expressly agree to have read, understood, and accepted these Terms and Conditions along with our Privacy Policy.

Service Information and License Descriptions

Personal-Use (Digital Album, EP, Single Downloads)

  • Scope:
    • Personal Listening: Music is intended solely for personal enjoyment and cannot be used for public performance, distribution, or commercial purposes.
    • Digital Albums, EPs, and Singles: Includes downloads of complete albums, EPs, or singles in digital format.
    • No Commercial Use: Music cannot be used in any commercial capacity, including for advertisements or revenue-generating projects.
    • No Public Performance: Music cannot be played in public or shared on social media where it can reach a broader audience.
    • No Redistribution: The downloaded music cannot be redistributed or shared beyond personal use.
    • Non-Transferable: The license is for the individual who purchased or downloaded the music and cannot be transferred.
  • Examples of Personal Use:
    • Listening on personal devices (smartphones, tablets, computers).
    • Creating personal playlists for private enjoyment.
    • Enjoying music at home in a non-commercial setting.
  • Restrictions:
    • Commercial Projects: Not for use in advertisements, videos, or any media intended for public consumption or revenue generation.
    • Public Sharing: Cannot be shared on social media, websites, or other public platforms.

YouTube License

  • Scope:
    • Social Media Videos: Suitable for videos on platforms like YouTube, Facebook, Instagram, and TikTok.
    • Non-Monetized Content: Applicable for videos that do not generate direct revenue (e.g., no ads, donations, or merchandise sales).
    • No Sponsorship: For videos that are not sponsored by third-party brands or companies.
    • Personal Projects: Ideal for personal vlogs and non-commercial media.
    • Non-Profit Content: Can be used for non-profit videos as long as they adhere to non-monetization and no-sponsorship conditions.

Standard License

  • Scope:
    • Social Media Videos: Suitable for videos on platforms like YouTube, Facebook, Instagram, and TikTok.
    • Monetized Content: For videos generating revenue through ads, subscriptions, or other monetization methods.
    • No Sponsorship: Applicable for videos without sponsorships or paid promotions.
    • Content Creators: Designed for creators who earn revenue from social media but do not have sponsorship deals.
    • Ad Revenue: Suitable for videos with platform-generated ads, such as YouTube AdSense.
    • Affiliate Links: Can include affiliate marketing links if no sponsored product placements are featured.

Business License

  • Scope:
    • Monetized Videos: Suitable for all videos that generate revenue through ads, subscriptions, or other monetization methods.
    • Sponsored Content: Ideal for videos with sponsorships, paid promotions, or product placements from third-party brands.
    • Social Media and Beyond: For use on social media platforms and other online media like websites and blogs.
    • Commercial Projects: Perfect for corporate videos, promotional content, and branded entertainment.
    • Influencer Campaigns: For influencers working with brands on sponsored campaigns.
    • Affiliate Marketing: Can be used in videos with affiliate marketing links and sponsored content.
    • Advertisements: Applicable for online advertisements, including pre-roll, mid-roll, and post-roll ads.

Film & TV Broadcast License

  • Scope:
    • Monetized Content: Suitable for all monetized videos.
    • Sponsored Content: Ideal for content with sponsorships and product placements.
    • Theatrical Releases: For films distributed and shown in theaters.
    • TV Broadcasts: For TV programs, including series, commercials, and documentaries.
    • Streaming Services: Suitable for content on platforms like Netflix, Hulu, and Amazon Prime.
    • Commercial Projects: Designed for high-budget projects, including corporate videos and branded entertainment.
    • Advertisements: Can be used in any form of advertisements, whether online, on TV, or in theaters.
    • Public Screenings: Ideal for films or videos shown at festivals, events, or public screenings.

Payment and Refund Policy

  • Refunds: We provide refunds only for technical issues that prevent downloading the music file. If you experience such issues, please contact us for assistance.
  • Payment Methods: We accept major credit cards.

Licenses & Copyright Policy

  • Ownership: EPIKTON content is owned by Ramazan Yüksel or licensors. Users are granted a limited, non-exclusive, and revocable license for commercial and non-commercial use.
  • Trademarks: The use of EPIKTON trademarks, service marks, logos, and other features is prohibited without explicit permission.

Third-Party Services

EPIKTON may use third-party applications or services. These are subject to their own terms of use, and EPIKTON is not responsible for their behavior, features, or content.

User Content

  • Rights: Users retain ownership of content posted on EPIKTON but grant us a broad license to use it. We may remove content without notice if it violates our terms.
  • Monitoring: EPIKTON does not monitor user content but reserves the right to remove or disable access to content that violates our agreements.

  • Termination: EPIKTON may suspend or terminate access at any time. Users may also terminate their account.

Legal Disclaimer

  • Warranties: EPIKTON is provided “as is” without warranties. We are not responsible for third-party applications or content.

Limitations

  • Liability: EPIKTON is not liable for indirect, special, or consequential damages. The sole remedy for dissatisfaction is to stop using the service.

Severability and Waiver

  • Enforceability: Invalid provisions do not affect the remaining terms. Failure to enforce rights does not waive them.

Assignment

  • Rights: EPIKTON may assign terms or obligations. Users may not assign or transfer their rights.

Indemnification

Jurisdiction

Governing Law: Disputes are governed by the laws of Turkey, with exclusive jurisdiction in Turkish courts.
